Dogan v Semali Investments Ltd [2005] EWCA Civ 1036 (04 August 2005)

The appellant landlord opposed the grant of a new lease under section 30(1)(f) of the Landlord and Tenant Act 1954. The trial judge found that there was not a sufficient intention to redevelop. The Court of Appeal held that on the evidence the judge should have found that as there was a reasonable prospect of obtaining planning permission for redevelopment there was a fixed and settled desire to carry out the redevelopment. The landlord had therefore been able to satisfy ground f.
